The complaint was filed by LLB first year student, Abhishek Bhargava in the court of Judicial Magistrate First Class (JMFC), Dilip Gupta.
Just hours after the first poster of Bollywood star Aamir Khan's new film PK was released, an advocate from Kanpur filed a case against him and others related with the advertisement of the poster published in newspapers.
The case has been filed against promoters of the film, Aamir Khan, producer Vidhu Vinod Chopra and director Rajkumar Hirani.
Claiming that the poster was obscene, advocate Manoj Kumar said it had terribly hurt his sentiments. "When I received a copy of the newspaper, I was shocked with the poster. Newspaper reaches crores of people, including children and the elderly."
The case has been filed in the court of additional city magistrate VII under section 292 of the IPC, which deals with obscenity.
When it comes to the Philippine Law, "Obscene" refers to anything that is indecent or offensive or contrary to good customs or religious beliefs, principles or doctrines, or trends to corrupt or deprave the human mind, or is calculated to excite impure thoughts or arouse prurient interest, or violates the properties of language and human behavior, regardless of the motive of the producer, printer, publisher, writer, importer, seller, distributor or exhibitor such as, but not limited to:
(1) showing, depicting or describing sexual acts;
(2) showing, depicting or describing human sexual organs;
(3) showing, depicting or describing completely nude human
(4) describing erotic reactions, feelings or experiences on sexual female breasts;
bodies; acts; or
(5) performing live sexual acts of whatever form.
So if we based this PK Poster on our law, if people who may see this poster arouse, and because of his nude body that has shown in this poster, it is really possible to file an obscenity case against him and to the staffs of the movie.
However, Aamir Khan defended the poster saying that the poster is akin to 'key art', "This is not for publicity, not for us at least. In fact this poster embibes all the elements of the film."
Further citing the example of his earlier released film Taare Zameen Par, Aamir Khan added, "In the poster of Taare Zameen Par, the child (actor Darsheel Safary) is sitting in the front on the school bench and I am sitting behind him. So it is a kind of key art...the image that tells you much about the story and so is the poster of PK."
Later talking about the poster again, he said, "When you (audience) will watch the film then only you will be able to understand the idea behind (the poster). But I would just like to say that the kind of filmmaker, the kind of writer Rajkumar is, he always tries to present the things, his thinking, in a unique way and that's why I am his huge fan."
On the other hand, while the poster has managed to generate a lot of hyper around the film, the makers have had to deal with a case that was filed in a court in Kanpur against Aamir Khan, director Rajkumar Hirani and producer Vidhu Vinod Chopra, accusing them of promoting nudity and vulgarity through PK poster.
